Terms of Service

These Terms of Service ("Terms") govern your use of Fluenters. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the service.

The service

Fluenters is a language-learning app. The first lesson is free to try with no account. Creating a free account unlocks additional lessons. Full access to all lessons and levels currently requires a valid beta invite code, granted at no charge during the beta period. We plan to introduce a paid subscription for full access after the beta ends; these Terms will be updated to reflect pricing and billing at that time.

Beta disclaimer

Fluenters is currently in a beta testing phase. The service is provided "as is" and "as available." Features, lesson content, and availability may change, be added, or be removed at any time without notice, and we don't guarantee uninterrupted or error-free access during this period.

Your account

You're responsible for providing accurate information when registering and for keeping your password secure. You're responsible for all activity that happens under your account.

Beta access

Some content requires a valid beta invite code. Invite codes are limited and may expire or stop working once the beta program ends or reaches capacity. We may revoke beta access granted through misuse of an invite code.

Acceptable use

You agree not to:

  • Copy, scrape, redistribute, or resell lesson content or audio without our permission
  • Share or misuse beta invite codes outside their intended distribution
  • Attempt to interfere with or disrupt the service
  • Use the service for any unlawful purpose

Intellectual property

All lesson content, audio, and related materials are owned by Fluenters (or licensed to us) and are provided for your personal, non-commercial use only.

Third-party links

Fluenters may link to third-party sites or services, such as our YouTube channel or a Google Form for feedback. We're not responsible for the content or privacy practices of those third-party services.

Termination

We may suspend or terminate your account if you violate these Terms; if we do, your account record and data will be permanently deleted, the same as if you'd deleted the account yourself. You can delete your own account at any time from within the app.

Disclaimer of warranties

To the fullest extent permitted by law, the service is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent permitted by law, Fluenters is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you for any claim arising from these Terms or your use of the service will not exceed the amount you paid us in the 12 months before the claim arose (which is $0 during the free beta period).

Force majeure

We're not liable for any failure or delay in the service caused by events outside our reasonable control, including outages of infrastructure we rely on (such as Microsoft Azure), natural disasters, or other circumstances beyond our control.

Indemnification

You agree to cover our reasonable costs and damages arising from your violation of these Terms or your misuse of the service, including claims made by others as a result.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and you agree to the exclusive jurisdiction of the courts of Ontario for any dispute arising from these Terms. This doesn't limit any mandatory consumer protection rights you have under the law of your own country or province of residence, where applicable.

Minimum age

You must be at least 16 years old to use Fluenters. If we introduce paid subscriptions in the future, purchasing one will require you to be at least the age of majority in your jurisdiction of residence (18 in Ontario) — these Terms will be updated to reflect that requirement at that point.

Electronic communications

By creating an account, you consent to receive communications from us electronically, such as emails for account confirmation and password resets. These satisfy any legal requirement that such communications be in writing.

Assignment

We may transfer or assign these Terms (for example, if we sell or restructure the business). You may not assign your account or these Terms to anyone else.

Severability and entire agreement

If any part of these Terms is found unenforceable, the rest remains in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Fluenters regarding the service.

Changes to these Terms

We may update these Terms as the service evolves, particularly as we move from beta to a paid subscription model. We'll update the "last updated" date above when that happens.
